Terms of Use

These terms apply to this website and to the project documents you send us through it.

01

Who these terms are between

This website is operated by Fire Rated Systems Pty Ltd, ABN 65 276 259 386, of Level 12, 197 St Georges Terrace, Perth WA 6000. In these terms, we, us and FRS mean that company, and you means the person or organisation using this website.

By using this website, or by sending us an enquiry or a file through it, you accept these terms. If you do not accept them, do not use the website. If you are accepting them for an organisation, you confirm you are authorised to do so and that these terms bind it.

02

Information on this website

The technical information on this website is general. Passive fire outcomes depend on the actual construction, the services involved, the required fire resistance level, the tested system and the condition on site. Nothing on this website is project-specific advice, and nothing on it establishes that an installation, product or building is compliant, certified or approved.

Australian Standards and the National Construction Code are referenced in general terms only. We do not reproduce their text. Where an answer depends on those documents, obtain them and take project-specific advice.

03

Enquiries and quotes

Sending an enquiry does not engage FRS, book work, hold a date or create a contract. Neither does receiving a quote from us. Work is engaged only when FRS and you agree it in writing, and the terms of that agreement — not this page — govern it.

A quote is based on the information available to us when we prepare it. Where the site condition, the construction or the evidence turns out to differ from what we were given, the scope and the price may have to change, and we will tell you before proceeding.

04

What you confirm when you upload

By uploading files you confirm that you are authorised to provide them to us, and that doing so does not breach an obligation you owe to someone else. If your project documents are subject to a confidentiality agreement, check before you send them. We treat what you send as confidential to your project and use it only to assess and deliver your enquiry, unless you separately tick the box asking us to contact you about other services.

If someone else brings a claim against us because you sent us material you were not authorised to send, you agree to meet the reasonable costs of dealing with that claim. What you can be asked to meet is capped at the greater of two figures: the amount you have paid or agreed to pay us for the work the material relates to, and $20,000. Where no work has been quoted or engaged, the cap is $20,000.

That cap does not apply where you sent the material fraudulently, or knowing you were not entitled to send it. In those circumstances your liability is not limited by this clause.

This does not apply to the extent the claim arises from something we did or failed to do, and nothing in it affects your rights under the Australian Consumer Law.

05

Using this website properly

Use the website for its purpose: reading the information and contacting us. Do not attempt to gain unauthorised access to any part of it or to the systems behind it, do not upload anything containing malicious code, do not interfere with its operation or with anyone else's use of it, and do not harvest its content by automated means for republication.

We may withdraw access to the website from anyone who does. We may also change, suspend or withdraw any part of the website at any time.

06

Liability

Your rights under the Australian Consumer Law are not affected. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law, to the extent that it cannot lawfully be excluded, restricted or modified. Where we are liable under a consumer guarantee that cannot be excluded, and the services are not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited, at our option, to supplying those services again or paying the cost of having them supplied again.

Subject to that, this website is provided as it is. We do not warrant that anything on the website is complete, current or suitable for your project, or that the website will be available without interruption or free of error.

You decide whether anything here applies to your project. Passive fire outcomes depend on the actual construction, the services involved, the required fire resistance level, the tested system and the condition on site. Do not rely on this website as the basis for a construction, compliance, certification or safety decision. Where the decision matters, obtain the relevant Standard or NCC provision and project-specific advice.

Subject to the first paragraph of this section, we are not liable for any loss or damage — including loss of profit, revenue, opportunity or data, rectification cost, or any indirect or consequential loss — arising out of or in connection with your use of this website, your reliance on anything published on it, or the website being unavailable. That applies whether the claim arises in contract, in tort including negligence, under statute or otherwise.

Nothing in this section limits our liability for death or personal injury caused by our negligence, or for fraud.

Work we carry out for you is a separate matter. These terms govern this website. Any inspection, installation, rectification, certification or maintenance FRS performs is governed by the contract for that work, and nothing on this page reduces what we owe you under it.

07

Intellectual property

The content of this website belongs to Fire Rated Systems Pty Ltd. You may read it, print it and share links to it. You may not republish it as your own, or use it to train a model or build a competing service. Files you upload remain yours.

08

Other organisations' websites

Where we link to a standards body, a regulator, a manufacturer or another organisation, we do so because the source is useful. We do not control those websites and are not responsible for their content or availability.

09

Privacy

How we handle personal information, and what happens to the files you send us, is set out in our Privacy Policy. It forms part of these terms.

10

If part of these terms does not apply

If a court finds any part of these terms unenforceable, that part is severed and the rest continues to apply. If we do not enforce a term straight away, we do not give up the right to enforce it later.

11

Changes to these terms

We may update these terms. The version published on this page when you use the website is the version that applies, and the date of the last substantive change is shown at the end of this page.

12

Which law applies

These terms are governed by the law of Western Australia. You and Fire Rated Systems Pty Ltd submit to the non-exclusive jurisdiction of the courts of Western Australia and the courts that hear appeals from them.

If you have a question about these terms, email admin@fireratedsystems.com.au or call (08) 6149 5444.
